Article 1 - Object
The present general sales conditions define the terms and conditions according to which all physical or moral persons of french or other nationality (hereinafter the "client") orders and buys the articles proposed by the company Majestic Provence on its web site (hereinafter the "site") accessible at the following address :

Article 2 - Acceptance of the general terms and conditions
As soon as the Client fills in the order form figuring on the Site and confirms the order, by clicking on the specific button, she/he accepts fully and entirely the present general sales conditions, which are only applicable to this specific contract. These general sales conditions can be consulted by the Client at any moment, simply by clicking on the heading "Sales conditions" of the menu "Services" accessible from any page of the Site.
Article 3 - Characteristics of the goods and services offered
The articles selected and presented for sale by Majestic Provence on the Site (hereinafter "the Products") are representative of the decoration and way of life in Provence. There are, notably, decoration articles and household equipment, beauty, health or well-care products or fine foods.
Majestic Provence makes known to the consumer the whole of the principal characteristics of the products. Generally, these characteristics may concern the dimensions, the weight, the quantities, the colours or the composition of the Products sold. These characteristics appear after clicking on the product name. The Client recognises that the photograph representing the Products on the Site has only an indicative value. The products or their presentation can vary from the pictures.
Article 4 - Price
The Client may choose to consult and buy the Products in the following currencies : Euro (EUR), Swiss Franc (CHF), Dollar (USD), Canadian Dollar (CAD), Sterling Pound (GBP), Japonese Yen (JPY).
For the countries of the European Union, the prices include the VAT. The total price of the VAT is indicated on the summary of the order. The VAT rate applied is valid for the day of the order.
For the other countries, the prices are indicated without VAT on the Site. If the delivery takes place outside the European Union, the consecutive customs charges and formalities will exclusively be at the charge of the Client. The acquittal of these taxes could be demanded at the Customs, by the intermediary of the transporter, at the moment of the delivery or retrieval of the packet. Les prix de vente des Produits sont susceptible de modification. Le prix de vente retenu pour l'achat d'un produit correspond à celui observé en ligne au moment de l'enregistrement de la commande.
The transport costs are invoiced in addition to the sales price of the Products, except for specific offers which are announced online. They are dependent on the weight and the country of delivery.
Article 5 - Order
The Client orders from Majestic Provence by filling in an order form on the Site. After having validated his/her order (5.1.), the Client must identify himself (5.2.) then transmit and pay for his/her order (5.3). Once accepted, the order will be confirmed by e-mail (5.4.).
5.1.Validation of the order
The Client, after having chosen the Products she/he wishes to buy, validates the order after seeing the order on the screen. The Client must select the country of billing and the country of delivery in order to calculate the transport costs. If she/he disposes of a reduction, the Client must type in the code in the specific place in order to benefit.
The summary indicates notably :
- the wording of the selected products, their reference and unit price
- the transport costs
- the amount of the possible reduction
- the currency of the chosen payment
- the total price to be paid by the Client
5.2.Identification of the Client
After having validated his/her order, the Client must identify himself. By, filling in on the Site a form put at his/her disposition. The Client will specify his/her name and first name, e-mail address, postal address (and delivery address if different), telephone number (and delivery telephone number if different). Majestic Provence reserves the right to check the exactitude of all information typed in by the Client, notably his identity and address, before the Products are sent.
The Client also chooses his mode of payment, bank card (default) or cheque.
5.3.Payment
The Client confirms his/her order by typing in the bank card number and the date of expiry. The payments by bank card are secured by a system of online payment defined by SSL.
If the Client chooses to pay by cheque, a summary of the order can be printed. This order and the cheque, to the order of Majestic Provence, can then be sent to the address indicated.
5.4.Confirmation of the order
To guarantee the wishes of the consumer, Majestic Provence, commits themselves to confirm all order, by e-mail within 24 hours following the reception of the order. This confirmation will include the wording of the ordered good, its price and the chosen payment mode.
These confirmations will be stored on the premises of Majestic Provence and will be considered as proof of the nature and date of the contract.
Article 6 - Conditions of payment
The price of the Products is payable :
- Either by bank card, the day of the order.
The cards accepted by Majestic Provence are the cards carrying the following logos CB, VISA or EUROCARD/MASTERCARD. The payments by bank card are secured by a system of online payment to SSL norms.
The order confirmed by the client will only be considered as effective by Majestic Provence when the concerned payment centres have given their authorisation. In case of refusal, the order will by automatically cancelled and the client informed by e-mail or by letter.
- Either by cheque (France only) or SWIFT transfer.
The order will only be considered as effective by Majestic Provence when the cheque has been received and cashed.
Also, Majestic Provence reserves the right to refuse all order from a client who has previously been the object of a process.
Article 7 - Delivery
Majestic Provence accepts the order and starts the delivery from the reception of the payment.
The delivery of the ordered articles takes place at the home of the buyer or at any address indicated at the moment of the order. The delivery (at the delivery address) is assured by a specialised transporter. The delivery delays indicated on the Site are indicative and in function of the country of delivery.
Majestic Provence commits itself to deliver the Products in the 15 days following the order (except in the case of certain Products requiring a delay : this additional delay will be indicated on the product form).
If the good is unavailable, the buyer will be informed as soon as possible and he may cancel his order. He may ask for a replacement or a refund.
At the moment of the delivery, the Client must check the general aspect of the packaging and of the delivered Products.
In case of damage or missing Products, the Client must write out his reserves on the delivery form and confirm them to Majestic Provence by recommended letter and by e-mail within 24 hours following the delivery.
All complaints must be addressed to the address indicated in article 1.
Article 8 - Guarantees and withdrawal
In accordance with the article L.121-16 of the Consummation Code, the client, from the moment of the delivery, has at his disposal, a delay of 7 full days, to return the ordered product for an exchange or for a refund. The costs of the return are at the charge of the Client. In case of exhange or refund, the Client must indicate this to Majestic Provence by recommended letter and by e-mail within 24 hours following the delivery.
The product returned must imperatively be in the original packaging which must be intact and accompanied by any accessories, explanation notices or books.
Article 9 - Nominative information
The nominative information required by the Site are indispensable for the correct transport and delivery of the orders and the bills.
However, they will only be used and communicated for this reason or in order to satisfy the legal and reglementary obligations.
Information given by the Client is stored electronically, and the consumer is deemed to have knowledge of this. The Client has the right to access and to modify any information held by Majestic Provence. To modify any information, please write to the adress given in article 1.
Article 10 - Ownership rights
Majestic Provence conserves the ownership of the ordered products until the effective and total payment of their price. If for any reason the product delivered to the client, has not been paid for, Majestic Provence could take back this product.
Article 11 - Law
These General Terms and Conditions are governed exclusively by French law. All litigation or disputes between the parties shall be brought only before the competent court in Marseille. In the event that disputes might arise out of this contractual agreement, both parties agree to attempt first to resolve the matter in a non-judicial setting.
